Anwar al-Awlaki was killed by a U.S. drone in Yemen recently. He was an American citizen, born in New Mexico. He allegedly had ties to the 9/11 terrorists, the Ft. Hood killer and the attempted shoe bomber. Here is some more of his history, including the fact he was in U.S. custody in 2002 but was released on orders of the Assistant U.S. Attorney in Denver.

That arrest was for passport fraud.

The warrant would have given terror investigators the right to hold Awlaki, who was on a terror watch list, on charges of felony passport fraud. “It was a determination of our office that we couldn’t prove the case beyond a reasonable doubt and we asked the court to withdraw the complaint,” Gaouette, U.S. Attorney for the District of Colorado, told ABC News. Gaouette, who in 2002 was the assistant U.S. attorney who supervised the Awlaki case, said he took responsibility for rescinding the warrant.

So far as I can find no other arrest warrant was issued for al-Awlaki.

Thus we have a case where criminal terrorist attacks were done or attempted on U.S. soil. One person who is credited or discredited with inspiring or conspiring in those acts is a United States citizen, born and raised and educated here, who was living elsewhere.

He was not charged for his role in these crimes, nor was extradition from Yemen attempted, no matter the chances for success.

Here is the text of the Fifth Amendment to the United States Constitution:

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be put  twice in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation. (Emphasis added)

al-Awlaki was not indicted, was not charged, and was most definitely deprived of his life without due process of law. He was not an enemy combatant. He resided in Yemen which is NOT at war with the U.S. His alleged misdeeds are acts for which there have been indictments and formal charges in the U.S. for the actual accused miscreants. As impractical as it may have been, why was he not also charged with these crimes and actions taken to return him home for trial?

No, we have our government utterly bypassing the Fifth Amendment to simply murder him. Do you realize that this same rationale could be applied to you or me? Obama or any President could simply declare we are terrorists and thus have everyone shuddering in their boots regardless of any evidence or lack thereof of the accusation. Then that Commander in Chief could summarily order your execution so you would have no chance to defend yourself.

Those of you who have bought into this anti-terrorist rhetoric whole-heartedly under our past two Presidents are weaklings who are willing to have your rights violated time and again in the name of the War on Terror which is a fraud of the first order. Even if it is not your rights being violated it should still disturb you that anyone’s rights are compromised because it could happen to you next, without warning and without cause.

Some people say we should trust the President on these matters. President Obama has even received backing from Rep. Peter King (R,. N.Y.) who generally disagrees with the administration. There are people applauding this latest assassination as they applauded the murder of Osama bin Laden even as they still dispute Obama’s birthplace.

My goodness, they won’t believe a man tells the truth about his birth certificate for which he has produced evidence but will believe him when he declares someone a teroorist without documentation? Un-fucking-believeable!!

In 1997 we had a House of Representatives eager to bring impeachment charges against a President who got blow jobs in the White House. But I hear no talk about the possible impeachment of either of our last two Presidents who have overseen frequent and officially sanctioned violations of our Constitutional rights.

There is no U.S. Attorney with the guts to do this. Thus I must take it upon myself to announce that I have established my own Grand Jury consisting of me, and this  Grand Jury has examined the evidence and we hearby indict Barack Hussein Obama for the murder of Anwar al-Awlaki with malice aforethought and for the murders of unknown victims killed in that same act, in violation of the laws of the United States of America, its Constitution, and all laws of morality.
